1. Acceptance of Terms

By registering an account, accessing any content, or subscribing to a paid plan on PromptBrain.io, you confirm that:

You are at least 18 years of age, or the age of legal majority in your jurisdiction.

You have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a company or organisation, you have the authority to bind that entity to these Terms.

2. Description of Service

PromptBrain.io is an AI prompt library providing curated, expert-crafted prompts across multiple categories including finance, health, career, marketing, legal, travel, and more. The Service is offered under the following tiers:

2.1 Free (Freemium) Tier

Access to a limited selection of up to 3 prompts per session or visit.

No credit card required to access free prompts.

Certain prompts and categories are restricted to paid subscribers only.

2.2 Pro Subscription

Full access to 870+ prompts across all categories.

Access to the Elite Vault and premium content.

Billed at $4.99 per month (or such price as displayed at the time of purchase).

Subscription renews automatically on a monthly basis unless cancelled.

3. User Accounts

3.1 Registration

To access certain features, you must create an account by providing a valid email address and password. You agree to provide accurate, current, and complete information and to update it as necessary.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@promptbrain.io if you suspect any unauthorised use of your account. We will not be liable for any loss or damage arising from your failure to keep your credentials secure.

3.3 Account Termination by User

You may close your account at any time by contacting us at support@promptbrain.io. Upon closure, your access to paid content will terminate at the end of the current billing period.

4. Subscriptions and Payments

4.1 Billing

Paid subscriptions are billed monthly via Stripe, our third-party payment processor. By subscribing, you authorise PromptBrain to charge your selected payment method on a recurring basis until you cancel.

4.2 Price Changes

We reserve the right to change subscription pricing at any time. We will provide at least 14 days' notice of any price increase by email. Continued use of the Service after the effective date constitutes acceptance of the new price.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@promptbrain.io. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the period ends.

4.4 Refunds

All subscription fees are non-refundable except where required by applicable law, or at our sole discretion in exceptional circumstances. If you believe you are entitled to a refund, please contact support@promptbrain.io within 7 days of the charge.

4.5 Failed Payments

If a payment fails, we will attempt to recharge your payment method. Continued failure may result in suspension or downgrade of your account to the free tier.

5. Intellectual Property

5.1 Our Content

All prompts, content, text, graphics, logos, and other materials on PromptBrain.io ("PromptBrain Content") are owned by or licensed to PromptBrain.io and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from PromptBrain Content without our express written permission.

5.2 Licence to Use

Subject to these Terms and your active subscription (where applicable), PromptBrain grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the prompts for your personal or internal business purposes. This licence does not include the right to:

Resell, sublicense, or commercially distribute prompts to third parties.

Publish or share prompts in bulk on third-party websites, newsletters, or marketplaces.

Train, fine-tune, or otherwise use prompts to develop competing AI products or services.

Represent PromptBrain prompts as your own original work in a commercial context.

5.3 User-Generated Content

If you submit feedback, suggestions, or other content to PromptBrain, you grant us a perpetual, royalty-free, worldwide licence to use, modify, and incorporate that content into the Service without restriction or compensation to you.

6. Acceptable Use

You agree not to use the Service to:

Violate any applicable law or regulation.

Infringe the intellectual property rights of any third party.

Transmit harmful, offensive, defamatory, or fraudulent content.

Attempt to gain unauthorised access to our systems or other users' accounts.

Scrape, crawl, or systematically extract data from the Service without our written permission.

Circumvent any access controls, paywalls, or usage limits.

Use the Service for any unlawful, abusive, or harmful purpose.

We reserve the right to suspend or terminate your account if you breach these usage policies, without prior notice and without refund.

7. Disclaimers

7.1 No Professional Advice

The prompts and content provided on PromptBrain.io are for informational and productivity purposes only. Nothing on this Service constitutes financial, legal, medical, tax, investment, or other professional advice. You should always consult a qualified professional before making decisions based on information generated using our prompts.

7.2 AI-Generated Outputs

PromptBrain provides prompt templates designed to be used with third-party AI tools (such as ChatGPT, Claude, and others). We do not control or take responsibility for the outputs generated by those AI systems. AI outputs may be inaccurate, incomplete, or inappropriate for your specific situation. Use them at your own risk and with appropriate judgement.

7.3 No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PromptBrain.io and its affiliates, directors, employees, and agents shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.

Loss of profits, revenue, data, business opportunity, or goodwill.

Damages arising from your reliance on prompt outputs or AI-generated content.

Any unauthorised access to or alteration of your data.

In all cases, our total aggregate liability to you shall not exceed the greater of (a) the total subscription fees paid by you in the 3 months prior to the claim, or (b) USD $50.

9. Privacy

Your use of PromptBrain.io is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. We use Supabase for authentication and data storage, and Stripe for payment processing. Both are GDPR-compliant services. We do not sell your personal data to third parties.

10. Third-Party Services

The Service integrates with or links to third-party services including Stripe (payments), Supabase (authentication), and various AI platforms. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

11. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time with or without notice. We will endeavour to give reasonable advance notice of significant changes.

We may update these Terms from time to time. When we do, we will update the Effective Date above and notify you by email or through the Service. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PromptBrain.io is registered, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If that fails, disputes shall be submitted to binding arbitration or the courts of competent jurisdiction in the applicable territory, as determined by applicable law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or any applicable law. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PromptBrain.io with respect to the Service and supersede all prior agreements, representations, and understandings.
